Terms of Use

  1. INTRODUCTION:

    1. RELIANCE INDUSTRIES LIMITED ("RIL" or "we" or "us" or "our") is the author, owner and publisher of mobile application JioHealthHub ("App"). Both the Website and the App together shall be referred to by the name of 'JioHealthHub' wherever applicable in these terms and conditions ("Terms"). RIL owns and operates all the services provided through JioHealthHub ("Services"). Please thoroughly go through these Terms and the privacy policy available at Privacy Policy before you decide to access and/or use JioHealthHub or avail the Services. These Terms and the Privacy Policy together constitute a legal agreement ("Agreement") between you and RIL. This Agreement defines the terms and conditions pursuant to which you can use JioHealthHub, avail related Services and/or access and maintain your account as a registered member with JioHealthHub. By accessing, downloading, registering and/or using JioHealthHub and/or by clicking the "I Agree" button, you unconditionally agree to follow and be bound by this Agreement. If you do not agree to be bound by and comply with all of the terms of this Agreement, you may not access, download, register and/or use JioHealthHub and its related Services.
    2. The Agreement applies to you whether you are an individual, patient, his/her representatives, successor, assign or affiliates, accessing, downloading, using and/or storing medical data or personal information through JioHealthHub ("End-User", "you", "your", or "User").
    3. This Agreement applies to all Services made available by JioHealthHub including but not limited to (i) facility to create and maintain an individual User account on the JioHealthHub known as the 'Health Account', (ii) be able to access, upload, store and/or download User health data, documents, reports, and/ or other related information provided by you and/or your health service provider ("Data"), (iii) be able to view and maintain such Data and other information uploaded by User and/or your health service provider, and (iv) share Data and/or other information as permitted.
    4. This Agreement supersedes all other previous oral and written terms and conditions (if any) communicated to you. Your access and/or use of JioHealthHub and the Services will be solely at the discretion of RIL. We reserve the right to modify, edit or terminate JioHealthHub, Health Account, related Services and this Agreement or any portion thereof for any reason, at our sole discretion and at any time. Such change shall be informed to you as a notification on the App or shall be prominently displayed as notices on the JioHealthHub Website portals. Please do read the Agreement and related updates provided thoroughly at regular intervals. Your continued access and/or use of JioHealthHub and/or your Health Account following any such modification/updates constitutes your agreement to follow and be bound by the Agreement and/or related Services so modified. Any additional rules, regulations, terms and conditions, disclaimers, and other policies applicable in general and/ or to specific areas of JioHealthHub or to particular Service pursuant to applicable law are also considered to be a part of this Agreement. If you do not agree with any part of the Agreement and the updates provided, please refrain from using JioHealthHub and any of the Services provided.
    5. The Agreement is published in compliance of, and is governed by the provisions of Indian law, including but not limited to:
      • the Indian Contract Act, 1872;
      • the (Indian) Information Technology Act, 2000 ("Act");
      • the rules, regulations, guidelines and clarifications framed there under, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”), and the (Indian) Information Technology (Intermediaries Guidelines) Rules, 2011 (the “IG Rules”); and
      • all applicable amendments of the aforementioned.

  2. CONDITIONS OF USE:

    1. You must be eighteen (18) years of age or older to register with JioHealthHub and use the Services in any manner. By accessing, registering, and/or using JioHealthHub you represent and warrant to us that you are eighteen (18) years of age or older, and that you have the right, authority and capacity to use JioHealthHub and the Services available through JioHealthHub.
    2. JioHealthHub is currently provided free of charge, and the App is intended to be downloadable on Android and IOS operating systems. We may at any time charge subscription or membership fees which the User shall pay as consideration for continued access and use of the Services, pursuant to the Agreement.
    3. We operate and have operated JioHealthHub from India and make no representation that the Services, content on JioHealthHub (“Content”) will be available in other locations. JioHealthHub may refer to products, programs and services that may not be available in your region/country. Users must comply with all laws applicable to them in relation to the use of JioHealthHub and its information and Contents.
    4. JioHealthHub is primarily for and as a matter of general convenience of the User for broad informational purposes to which the Contents relate. Promotions and advertisements of and use of products and services, as also access and linkages to websites and other applications (including of third parties) may also be enabled by the App use.

  3. TERMS OF USE:

    1. If JioHealthHub enables this, you may if you choose to, on a voluntary basis, post or submit information, reports, documents, text, photographs, images, illustrations, designs, graphics, audio, video, ideas, suggestions, Data and proposals. Also, We may request you to post / submit some of your personal information (such as name, address, contact numbers, e-mail address, date of birth, medical history, related documents, personal and health related information and other things, as applicable) generally and in some cases for you to seek certain Services, which you may choose to do on a voluntary basis. By using the Services and doing any of the above, you represent and warrant that: (i) you own or in any event have the right to post and/or submit the aforesaid, free of restrictions, and this will not result in infringing any right of any person or entity, and (ii) we will have an enterprise-wide, non-exclusive, royalty free, irrevocable, transferable and sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display the aforesaid (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed throughout the world. Further, you agree that the personal information provided to us by you through JioHealthHub will be governed by our Privacy Policy at Privacy Policy. JioHealthHub in order to provide Services, shall collect certain information relating to the location, devices used to access JioHealthHub, etc. as applicable and anonymous data of your usage. The collected information will be used only for improving the quality of JioHealthHub’s Services and to build new services and platforms. JioHealthHub shall not be responsible in any manner for the authenticity of the Data, personal information or sensitive personal data or any other information supplied by the User to JioHealthHub or to any other person acting on behalf of JioHealthHub. The User is responsible for maintaining the confidentiality of the Health Account and related access information. The User shall be responsible for all usage of the Health Account, whether or not authorized by the User. The User shall immediately notify JioHealthHub of any actual or suspected unauthorized use of its Health Account. JioHealthHub shall not be liable for any losses caused by any unauthorized use of your Health Account. If a User provides any Data and/or information that is untrue, inaccurate, infringing, not current or incomplete (or becomes untrue, inaccurate, infringing, not current or incomplete), or JioHealthHub has reasonable grounds to suspect that such Data and/or information provided by User is untrue, inaccurate, infringing, not current or incomplete, JioHealthHub has the right to delete such Data and/or information and discontinue the User Health Account and Services to such User at its sole discretion.
    2. JioHealthHub provides Users with an individual Health Account on the following terms:
      • Your Health Account is only created after you have signed up and explicitly accepted the Agreement.
      • Information available in your Health Account is of the following types:
        • End-User-Created: Information and/or Data generated and uploaded by you for your Health Account.
        • Health Service Provider-Created: Information and/or Data generated for you by your health service provider and/or uploaded by your health service provider in JioHealthHub as applicable.
        • Other: information such as commercial content, notifications, advertisements and other such ancillary data.
        • Curated Content by JioHealthHub: Information and/or data generated and published for you by JioHealthHub such as health tips, informational content and other such ancillary data.
    3. All information created by your health service provider is provided on an "as-is" basis to us and JioHealthHub does not validate the said information and makes no representation in connection therewith. JioHealthHub is not responsible for any such information provided and/or created by your health service provider, you should contact your health service provider in case you wish to point out any discrepancies or add, delete, edit or modify such information in any manner. The Health Account is provided on a “best-efforts” and “as-is basis”. While we strive to maintain the highest levels of service availability, we and/or JioHealthHub is not liable for any interruption that may be caused to your access of the Health Account and/or related Services.
    4. It is your responsibility to enter and maintain your correct updated access information and/or your updated Data in your Health Account. End-User-Created information and related Data shall be provided to the account associated with the respective User provided contact mobile number. Every time you change your contact information, we will validate the same before updating such information in our systems. JioHealthHub is not responsible for any loss or inconvenience caused due to your non-performance with regards to your Health Account.
    5. JioHealthHub uses industry standard security measures and encryption of your Health Account. However, JioHealthHub cannot guarantee and/or prevent unauthorized access, if you lose your device/mobile phone or if your Health Account is otherwise hacked or compromised due to your actions or inactions. Safeguarding your login credentials, access information and your Data with regards to your User Account is your responsibility and JioHealthHub encourages you to report any actual or suspected breach of your Health Account to care@jio.com at the earliest.
    6. JioHeathHub will allow you, at your risk, option and discretion, to securely share Data and other information (as applicable), using the available share functionality within the Website and/or the App, as applicable through your Health Account. Such User is responsible for such information, the access and sharing of the same and with whom he/she shares it with. JioHealthHub shall not be liable for any breach and/or loss resulting due to such sharing of the information by the User.
    7. Your health service provider, is responsible for sending and/or assigning the relevant records, information and/or Data to the relevant User. JioHealthHub shall not be responsible and/or held liable for any of your health service provider’s errors with respect to providing your information.
    8. User shall not access JioHealthHub, the Services for purposes of monitoring their availability, performance or functionality, or for any other benchmarking, commercial or competitive purposes.
    9. You as a user hereby represent and warrant that you will use JioHealthHub and the Services in accordance with applicable law. Any contravention of applicable law as a result of your use of JioHealthHub and related Services is your sole responsibility, and JioHealthHub accepts no liability for the same.
    10. Your use of each Service confers upon you only the rights and obligations relating to such Service, and not to any other service that may be provided by JioHealthHub
    11. JioHealthHub may disclose or transfer Data and/or any information provided by the User to its affiliates or governmental authorities in such manner as permitted or required by applicable law, and you hereby consent to such disclosure and/or transfer. JioHealthHub shall comply with applicable law with regards to the access and/or disclosure of any information provided by the User.

  4. DISCLIAMERS:

    1. USE OF JIOHEALTHHUB IS AT YOUR OWN RISK. WE MAKE NO REPRESENTATIONS OR WARRANTIES OR UNDERTAKINGS OR GUARANTEES OF ANY KIND FOR ANY PURPOSE WHATSOEVER, AND WE DO NOT ASSUME ANY LIABILITY, IN RELATION TO THE (AND IN RELATION TO THE USE OF) JIOHEALTHHUB, CONTENTS, MATERIALS, PRODUCTS, SERVICES, THIRD PARTY WEBSITES OR OTHER APPLICATIONS OR SERVICES THAT MAY BE ACCESSED THROUGH JIOHEALTHHUB. WITHOUT PREJUDICE TO THE GENERALITY OF THE FOREGOING, AND IN ANY EVENT WE DISCLAIM ANY AND ALL WARRANTIES AND REPRESENTATIONS (EXPRESS OR IMPLIED) IN THIS REGARD WHETHER ARISING BY OPERATION OF LAW, BY REASON OF CUSTOM OR USAGE IN THE TRADE, BY COURSE OF DEALING OR OTHERWISE, INCLUDING ANY AND ALL REPRESENTATIONS OR WARRANTIES RELATING TO (A) MERCHANTABILITY, (B) FITNESS OR SUITABILITY FOR ANY PURPOSE (WHETHER OR NOT WE KNOW, OR HAVE REASON TO KNOW OR HAVE BEEN ADVISED OR ARE OTHERWISE AWARE OF ANY SUCH PURPOSE), (C) NON-INFRINGEMENT OR CONDITION OF TITLE, AND (D) THAT JIOHEALTHHUB WILL OPERATE WITHOUT INTERRUPTION OR ERROR OR SHALL BE BUG OR VIRUS OR ERROR FREE. YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE NOT RELIED ON ANY REPRESENTATION OR WARRANTIES. THIS DISCLAIMER AND EXCLUSION WILL APPLY EVEN IF ANY EXPRESS REPRESENTATION OR WARRANTY IF ANY SET FORTH IN THIS AGREEMENT IS BREACHED AND/OR IS UNTRUE.
    2. The Content is not intended to be complete or accurate or updated and is not a substitute for any information or other medium of providing or obtaining information. We do not represent or warrant (nor do we assume any liability in this regard) the accurateness or the completeness of the Content, and we also do not make any representations or warranties (nor do we assume any liability in this regard) for anything or any matter relating to or arising out of any promotions, advertisements of or use of any products and services, or use by you of other websites and other applications (including of third parties) (including without limitation as to whether such third parties have all proprietary or intellectual property rights to display / use any content or material). Access to or use of such websites and other applications by you shall mean you have agreed to the relevant provider’s terms, including privacy policies, relating to access and use.
    3. It is also not intended that JioHealthHub and related Services provide medical advice or opinion and no medical advice or opinion contained in JioHealthHub and related Services should be relied upon for any purpose, and if it is we shall not be responsible or liable in that regard. It shall not be a substitute for proper medical or healthcare advice, which must be sought separately from professionals, without reference to JioHealthHub and related Services.
    4. JIOHEALTHHUB AND/OR WE ASSUMES NO RESPONSIBILITY, AND SHALL NOT BE LIABLE FOR, ANY DAMAGES TO, OR VIRUSES THAT MAY INFECT USER’S EQUIPMENT ON ACCOUNT OF USER’S ACCESS TO, USE OF, OR BROWSING JIOHEALTHHUB OR THE DOWNLOADING OF ANY CONTENT, MATERIAL, DATA, TEXT, IMAGES, VIDEO CONTENT, OR AUDIO CONTENT FROM THE JIOHEALTHHUB. IF A USER IS DISSATISFIED WITH JIOHEALTHHUB, USER’S SOLE REMEDY IS TO DISCONTINUE USING JIOHEALTHHUB.
    5. By accessing, downloading and using JioHealthHub (as applicable), you agree that any information shared by you with JioHealthHub will be subject to our Privacy Policy available at Privacy Policy. You are solely responsible for all the information, Data and content that you choose to submit or share on JioHealthHub. The role of JioHealthHub in sharing critical content is restricted to that of an ‘intermediary’ under the Act. JioHealthHub disclaims all responsibility with respect to the content of critical nature, and its role with respect to such content is restricted to its obligations as an ‘intermediary’ under the said Act. JioHealthHub shall not be liable to pay any consideration to any User for re-publishing any content across any of its platforms.
    6. We are entitled to at any time at our sole discretion: (i) change the terms and conditions contained herein; (ii) change / provide updates to JioHealthHub, including eliminating or discontinuing any Content, information, material on or feature of JioHealthHub and (iii) deny or terminate your use of and/or access to JioHealthHub and/or your Health Account. Upon termination, you shall immediately destroy any downloaded and printed materials of JioHealthHub.
    7. Once temporarily suspended, indefinitely suspended or terminated, the User may not continue to use JioHealthHub under the same Health Account, a different account or re-registration needs to be completed by the User, for facilitating a new account and/or using JioHealthHub and/or its Services. On termination of your Health Account, you shall no longer have access to information, Data, messages, files and other materials provided by you to JioHealthHub and/or maintained on JioHealthHub by you. We shall not be liable for any loss of Data on termination of your Health Account. You are responsible to maintain backup of any such Data and/or information you have provided.

  5. CONTENT OWNERSHIP AND COPYRIGHT CONDITIONS OF ACCESS:

    The Contents listed on JioHealthHub including but not limited to content curated for or by JioHealthHub and all information that is collected by JioHealthHub directly or indirectly from the Users and your health service provider shall belong to JioHealthHub. JioHealthHub authorizes the User to view and access the Content available on JioHealthHub solely for viewing, receiving and communicating only as per this Agreement. The contents of JioHealthHub including but not limited to information, text, graphics, images, logos, button icons, illustrations, software code, design, graphics and audio, video, written and other material including programs and codes and the collection, arrangement and assembly of content (collectively, "JioHealthHub Content"), are the property of JioHealthHub and are protected under copyright, trademark, proprietary and other intellectual property right laws. User shall not modify JioHealthHub Content or reproduce, display, publicly perform, distribute, or otherwise use the JioHealthHub Content in any way for any public or commercial purpose or for personal gain and JioHealthHub, its material and Content is owned by us or our affiliates, or in respect of which we have rights. If enabled by JioHealthHub, you may:
    • use and display the JioHealthHub Content as-is only on your personal cellular phone or tablet devices or computer system solely for personal use;
    • print copies of the JioHealthHub Content for your personal use and store the files on your cellular phone or tablet devices or computer system for personal use.

    Save as is otherwise permitted in the above section 5, you shall not use JioHealthHub Content and related material or the Content in any manner for any purpose.

  6. THIRD PARTY WEBSITES:

    JioHealthHub may contain links to websites operated by third parties ("Third Party Websites"). We do not have any influence or control over any such Third Party Websites and, unless otherwise stated, we are not responsible for and do not endorse any Third Party Websites or their availability or contents.

  7. ADVERTISERS ON JIOHEALTHHUB:

    We accept no responsibility for advertisements and/or promotional materials contained within JioHealthHub and/or provided through JioHealthHub. If you agree to purchase goods and/or services from any third party who advertises through JioHealthHub, you do so at your own risk and responsibility. The advertiser and/or related third party, not RIL, is answerable and/or responsible for such goods and/or services purchased by you and if you have any queries or complaints in relation to them, your only recourse is against the advertiser and/or related third party.

  8. RIGHTS AND OBLIGATIONS RELATING TO CONTENT:

    You shall not (without limiting your other obligations under the Agreement):

    1. restrict or inhibit any other user from using or enjoying JioHealthHub, including without limitation by means of "hacking" or defacing any portion of JioHealthHub;
    2. transmit any information or software that contains a virus, worm, time bomb, Trojan horse or other harmful or disruptive component;
    3. post or transmit to or from JioHealthHub any unlawful, abusive, pervasive, hateful threatening, libellous, defamatory, obscene, pornographic, offensive or racially, ethnically or otherwise objectionable or other similar material;
    4. indulge in cyber stalking, become or create a nuisance for any visitor/user of JioHealthHub;
    5. use JioHealthHub to conduct, or solicit the performance of, any unlawful activity or other activity which infringes the rights of others;
    6. interfere with or disrupt JioHealthHub or any Services provided thereon or thereby, or any servers or networks or operating systems connected to JioHealthHub, or disobey any requirements, procedures, policies or regulations of networks connected to JioHealthHub;
    7. use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine," or in any way reproduce or circumvent the navigational structure or presentation of JioHealthHub, Contents, Services, Data, information or related materials provided on and/or through JioHealthHub;
    8. reproduce, duplicate, copy, sell, resell or exploit for any commercial or unlawful purposes, the Contents, Services, JioHealthHub Content, information or related materials provided on and/or through JioHealthHub or any portion thereof, your right to use JioHealthHub, or your right to access any Services offered or made available on or through JioHealthHub;
    9. frame or mirror JioHealthHub or any portion thereof;
    10. impersonate any person or entity, misrepresent your affiliation with a person or entity, or misrepresent the origin of anything posted or submitted by you on or distributed through JioHealthHub.

  9. LIMITATION OF LIABILITY:

    To the maximum extent permitted by law, we, as well as our trustees, affiliates and officers, directors, employees and agents, will not be liable to you or anyone else for any direct or indirect / consequential / special / punitive damages or losses, personal injury, mental anguish, emotional distress, or any other personal loss (whether under law, contract or torts) that result from the access to or use of, or inability to access or use of, JioHealthHub, websites or other applications, or relating to the products or services received / to be received by use of JioHealthHub. If you are dissatisfied with any matter in relation to any of the above, or with any of these terms of the Agreement, your sole and exclusive remedy is to cease using JioHealthHub.

  10. INDEMNITY:

    User agrees to indemnify and hold harmless JioHealthHub, RIL, its affiliates, officers, directors, employees, consultants, licensors, agents, business partners and representatives from and against any and all third party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from User’s access to or use of JioHealthHub, Contents, Third Party Websites, Data, Services, applications or content, or products or services, or from posting / submitting anything and, violation of this Agreement, or infringement, or infringement by any other User of his/her/its account, of any intellectual property or other right of any person or entity. JioHealthHub will notify you promptly of any such claim, loss, liability, or demand, and in addition to your foregoing obligations, you agree to provide us with reasonable assistance, at your expense, in defending any such claim, loss, liability, damage, or cost.

  11. MISCELLANEOUS:

    1. Any and all claims and disputes, if cannot be amicably resolved between User and RIL shall be finally settled by reference to arbitration under the Arbitration and Conciliation Act, 1996 including any amendments or re-enactments ("Arbitration Rules") and to be administered by the arbitral tribunal agreed to by us and appointed pursuant to the Arbitration Rules. The arbitration proceedings shall be held in Mumbai, India. The arbitration proceedings shall be conducted in the English language. Notwithstanding the foregoing, we may seek appropriate interim or provisional reliefs including any injunctive reliefs in any court having jurisdiction over the subject matter thereof to enforce and/or prevent breach of our rights and remedies in and arising out of this Agreement.
    2. The Agreement shall be governed by the laws of India without giving effect to principles of conflict of laws and all disputes and differences hereunder shall be subject to the sole and exclusive jurisdiction of the courts situated at Mumbai, State of Maharashtra, Republic of India. The usage of JioHealthHub, Services, Website and the App is personal to you and you shall not assign or transfer this right to any third person. The Agreement contain the entire understanding and supersedes all prior understandings between the parties relating to the subject matter herein and the Agreement cannot be changed except in a writing or changed by RIL in the manner as provided in the Agreement. Any failure by us to enforce the Agreement, for whatever reason, shall not necessarily be construed as a waiver of any right to do so at any time. If any portion of the Agreement is held invalid or unenforceable by a court of competent jurisdiction, that portion will be construed consistent with applicable law as nearly as possible, and the remaining portions will remain in full force and effect.
